Terms of Service

Effective date: September 10, 2026

On this page

1. About These Terms

These Terms of Service (the "Terms") govern your access to and use of the website melbo.io, its subdomains, interfaces and related services (collectively, the "Platform"). The Platform is provided by MELBO ("we", "us", the "Platform"). By using the Platform you agree to these Terms. If you do not agree, do not use the Platform.

2. What the Platform Is — and What It Is Not

2.1. The Platform is a software interface providing access to prediction markets operated on a third-party decentralized liquidity protocol (the "Protocol"). Trades are entered into and settled by the Protocol's smart contracts on a public blockchain, not by the Platform.

2.2. The Platform is not an exchange, broker, dealer, clearing house, payment service, custodian, or an investment, tax or legal adviser. We do not execute trades, provide clearing, hold user funds, or give trading advice. No information on the Platform (prices, probabilities, commentary) constitutes investment advice, a recommendation, or an offer.

2.3. Non-custodial. Your wallet is created through a third-party embedded-wallet provider and is controlled by you: the private key is tied to your login method; the Platform has no access to it, does not store it, and is technically unable to dispose of your funds or reverse transactions. You may export your private key from the interface at any time and use the wallet outside the Platform.

3. Eligibility

3.1. You must be at least 18 years old (or older where the age of majority in your jurisdiction is higher) and have full legal capacity.

3.2. Restricted Jurisdictions. Use of the Platform for trading is prohibited for persons who reside in, are located in, are incorporated in, or are tax residents of: the United States of America, the United Kingdom, France, Singapore, Poland, Thailand, Taiwan, Australia, Belgium, the province of Ontario (Canada), as well as Iran, Syria, Cuba, North Korea, the regions of Crimea, Donetsk and Luhansk, and any jurisdiction subject to comprehensive sanctions of the UN, EU, US (OFAC) or the UK. The list may be updated; the current version is published on this page.

3.3. You represent and warrant that: (a) you are not located in and are not a resident of a Restricted Jurisdiction; (b) you are not included in any sanctions list; (c) you do not use a VPN, proxy or other means of concealing your location for the purpose of circumventing restrictions; (d) you use the Platform in your own name and for your own account; (e) your use of the Platform is lawful in your jurisdiction. You are solely responsible for compliance with your local laws.

3.4. We may restrict or terminate access upon violation of this Section, including blocking access from Restricted Jurisdictions.

4. Wallet and Security

4.1. Wallet access is tied to your login method (email, Google, Telegram). You are responsible for safeguarding that access and for all activity under your account.

4.2. Loss of access to your login method may result in loss of access to your wallet. Recovery is governed by the third-party wallet provider's rules; the Platform cannot recover the key for you.

4.3. Funds in the wallet are the USDC stablecoin on the Polygon network. The Platform does not issue USDC and is not responsible for its issuer, stability or convertibility.

5. Markets and Trading

5.1. Each market is a question about a verifiable event with resolution rules and data sources determined by the Protocol. The rules of a specific market prevail over any descriptions on the Platform.

5.2. Orders are created and cryptographically signed by you; the Platform relays signed orders to the Protocol without altering them and without adding its own signature. Execution, settlement and market resolution are performed by the Protocol.

5.3. The Platform does not influence market outcomes, resolution or payouts and does not guarantee their correctness, nor does it guarantee liquidity, order execution or availability of the Protocol.

5.4. Blockchain transactions are irreversible. An executed trade cannot be cancelled by you or by the Platform.

6. Fees

6.1. Current fees are published on the "Fees" page. Fees are withheld automatically by the Protocol upon execution.

6.2. Liquidity fees are charged by the Protocol for the benefit of liquidity providers and are not revenue of the Platform.

6.3. The blockchain network may charge fees (gas); their handling is described on the "Fees" page.

7. Risks

Use of the Platform involves substantial risks, including without limitation: total loss of deposited funds; price volatility; errors and vulnerabilities of smart contracts; blockchain failures and forks; stablecoin issuer risks; regulatory risks; the risk of a market resolving against you under the Protocol's rules. The full list is set out in the Risk Disclosure, which forms part of these Terms. Do not use funds you cannot afford to lose.

8. Prohibited Conduct

You must not: circumvent geographic restrictions; use the Platform for money laundering, terrorism financing or any other unlawful activity; manipulate markets (including wash trading and spoofing); interfere with the operation of the Platform, including attacks, scraping at volumes that disrupt the service, and attempts at unauthorized access; impersonate the Platform or its representatives; use the Platform on behalf of third parties without authority.

9. Intellectual Property

The Platform, its name, logo, interface and content belong to MELBO or its licensors. You are granted a limited, revocable, non-exclusive license to use the Platform as intended. Rights to the Protocol belong to its operators.

The Platform displays data from the Protocol and other third-party sources "as is" and does not guarantee its accuracy or timeliness. Links to third-party resources do not imply endorsement.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, uninterrupted operation and absence of errors. We do not guarantee continuous availability of the Platform, the Protocol or the blockchain.

12. Limitation of Liability

To the maximum extent permitted by law, MELBO, its members, employees and contractors shall not be liable for any indirect, incidental, punitive damages, lost profits, loss of data or funds arising from the use of the Platform, the Protocol, the blockchain or the wallet. The aggregate liability of the Platform for any claims is limited to the amount of Platform fees actually received from you during the 12 months preceding the claim, or USD 100, whichever is greater.

13. Indemnification

You agree to indemnify the Platform against losses, claims and expenses (including reasonable legal fees) arising from your breach of these Terms, applicable law or third-party rights.

14. Taxes

You are solely responsible for determining, reporting and paying any taxes applicable to your transactions.

15. Changes and Termination

15.1. We may amend these Terms; amendments take effect upon publication with an updated date. Material changes will be announced on the Platform. Continued use constitutes acceptance.

15.2. We may suspend or discontinue the Platform or your access to it. The non-custodial architecture means your funds remain under your control even if the interface ceases to operate: wallet access is preserved through the wallet provider or by exporting your private key.

16. Governing Law and Disputes

These Terms are governed by the laws of the British Virgin Islands. All disputes shall be resolved through negotiations and, failing agreement, by arbitration under the BVI IAC Arbitration Rules. You waive participation in class actions to the extent permitted by law.

17. Language

These Terms are published in English and Russian. In case of any discrepancy, the English version prevails.
